POLICIES AND PROCEDURES
Terms of Agreement
HIS/Family Net understands that using the Internet can be unclear and
confusing. It is not our goal to penalize someone for not fully
understanding how the Internet works. Instead, our goal is to help you
use the Internet effectively. We will, however, take action against
those few individuals who purposefully and repeatedly abuse the system.
By accessing the Internet using your HIS/Family Net account, you agree
to be bound by the Terms of Agreement. Each successive use by you of
the service reaffirms your agreement to be bound by and to abide by
the Agreement.
HIS/Family Net may discontinue or alter any aspect of the service at any
time without notice, without liability, and at HIS/Family Net's sole
discretion. The service period extends for 1 month and is automatically
renewed unless terminated by you or by HIS/Family Net.
You must be at least 18 years of age and assume responsibility for
the supervision of any minor using the account. You are responsible
for any activity by any person who uses your account. You are responsible
for maintaining the confidentiality of your password and for any liability
resulting from disclosure of your password. Should you become aware
that your password or account is being used without authorization, you
agree to immediately notify HIS/Family Net.
You are responsible for obtaining and maintaining the equipment and
telephone services necessary to access and use the service and for any
telephone charges associated with connecting to the HIS/Family Net system.
You are responsible for any additional charges incurred when accessing
any other site outside the HIS/Family Net system.
You agree that you will not use the service to disseminate broad-based
e-mailing without written permission of HIS/Family Net. You agree that
you will not use the service for transmission of chain letters or pyramid
schemes. Also, you shall not send unsolicited e-mail which, by definition,
includes information of any kind, advertisements, literary works, graphics,
voice and video files, and any other material that can be contained in e-mail.
You agree that you will comply with all laws applicable to use of the
service. You will not transmit threatening, abusive, harassing, vulgar,
obscene, defamatory, or other offensive material. HIS/Family Net retains
the right at any time to refuse or discontinue service if it, at its sole
discretion, with or without notice, determines inappropriate usage of the
service. You acknowledge that if an account is terminated, any unread
e-mail may be deleted from the system.
Use of the service is at your sole risk. Neither HIS/Family Net, nor its
agents, warrants that the service will be uninterrupted or error free, nor
do they make any warranty as to the results obtained from use
of the service. No oral advice or written (including electronic)
information provided by HIS/Family Net or its employees or agents
shall create a warranty.
HIS/Family Net shall not, under any circumstances, be liable for any
direct, indirect, incidental or consequential damages or losses that
result through the use of or inability to use the service, or that result
from mistakes, omissions, interruptions, deletion of files or e-mail, or
any failure of performance.
Either you or HIS/Family Net may terminate your access to the service and
your account at any time. An account must be cancelled by written notice
via fax, U.S. Mail, or e-mail from your Family Net account. Refunds will
not be issued if cancellation is received after billing for that service
month. Refunds will be issued for unused month's monies if service was
prepaid.
Services will be automatically cancelled upon non-payment. In the event
your account is past due, it may be turned over to a collection agency.
If your account is not paid in full and this account is turned over to
a collection agency and/or attorney, then you agree to be responsible
for all reasonable fees necessary for the collection of the delinquent
account including, but not limited to, collection agency fees of 50% of
the balance due and costs and reasonable attorney's fee of 33% of the
balance. There may be a service charge for late payment, returned checks,
or insufficient fund transactions. Your only right with respect to any
dissatisfaction with the terms, policies, or practices of HIS/Family Net
in operating the service, is to terminate your account.
Upon termination, you agree that you shall have no right to access any
stored content on the HIS/Family Net system and any such content will be
forfeited.
The Agreement and its enforcement shall be governed by, and construed in
accordance with, the laws of the State of Illinois. Any cause of action
brought by or on behalf of you with respect to this Agreement or the
service must be commenced within one year after the claim or cause of
action arose.
